The Federal District Court for the Eastern District
of Arkansas issued an order on February 23, 2004 dismissing a lawsuit
filed by six physicians against Baptist Health. The physicians were
seeking an injunction against the Baptist Health Conflict of Interest
Policy, which prohibited physicians with an ownership or investment
interest in a competing hospital from being eligible for medical
staff appointment or reappointment.
The physicians claimed that the policy violated
the Medicare Anti-kickback Law, but the court ruled that a private
right of action did not exist under that statute.
The issue of conflicts of interest is confronting
