New Interpretative Guidelines, which
instruct surveyors what to look for when investigating an EMTALA
complaint, were issued by CMS on Friday, May 14, 2004. These Guidelines
are effective immediately.
The revised Guidelines include a number of new
provisions and directions regarding EMTALA's on-call requirements.
Those provisions address:
- the ability to use non-physician practitioners
to assist the on-call physician by being the first responder to
the ED;
- the use of telemedicine as a means of response
by the on-call physician;
- new directions concerning "reasonable
call response time";
- more detail on what is required when a hospital
allows the on-call physician to take simultaneous or dual call;
- the use of the ED for non-emergency testing,
as well as for testing for blood alcohol, sexual assault and incarceration
clearance;
- what it means when the patient's emergency
medical condition has been stabilized but the patient's underlying
medical condition has not been resolved.
