On December 4,
2002, the Department of Health and Human Services, Office
of Civil Rights, issued
a 123-page document providing detailed advice about some
of the most controversial and confusing requirements of the
Privacy Rule. In this audiotape, Dan Mulholland, Alan Steinberg,
Rachel Remaley and Phil Zarone, attorneys at Horty, Springer & Mattern,
discuss the issues raised in that document, as well as other
issues, such as:
* Can a physician's office leave messages on patients'
answering machines?
* Do charts have to be kept under lock and key at all times?
* Can one patient's medical record be disclosed to treat another patient?
* Do providers need to enter into business associate agreements with the labs
they use?
