Must Hospitals Train Their Staffs to
Bite the Hand that Feeds Them?
Audio CD
Recorded September 11, 2006

Faculty: Dan Mulholland, Henry Casale, and Phil Zarone

If you are unhappy with what Medicaid is paying you, just wait. If you do not act soon, on January 1, 2007, you will be paid even less. That is because tucked in the back of the Deficit Reduction Act of 2005 is the mandate that any entity that receives more than $5 million per year in Medicaid reimbursement must adopt written compliance policies. Some have said that this will require hospitals to instruct its employees on HOW TO FILE A QUI TAM SUIT AGAINST THE EMPLOYER.

These requirements, along with increased federal funding for fraud enforcement and the DRA's financial penalty to states that fail to pass a Medicaid false claims act that includes a qui tam provision, promise to increase the number of qui tam suits and federal investigations related to fraud and abuse. Are you ready?

Horty Springer's Dan Mulholland, Henry Casale, and Phil Zarone discuss how hospitals can prepare for the new fraud and abuse environment. Dan, Henry, and Phil discuss:

  • what the Act requires to be included in compliance policies and employee handbooks
  • the effect of the Act on fraud and abuse enforcement
  • how to make revised compliance policies applicable to contractors and agents of the hospital
  • compliance training required by the Act
  • how to develop policies and training that satisfy the Act's requirements without encouraging the inappropriate use of whistleblower suits
  • what to do if your state has not yet adopted a qui tam law that applies to Medicaid
