Resignation of Privileges to Avoid
On Call Responsibilities —
How Do You Respond?

A neurosurgeon who has been on the staff for
a dozen years "resigns" all of his clinical privileges
except for spine surgery. The purported reason is that because
the physician has limited his practice to spine surgery, he no
longer feels competent to perform other procedures. The suspicion
is that the resignation has more to do with avoiding call responsibilities
than it does competence.
Sound familiar? Has the physician tied your
hands?
Barbara Blackmond and Phil Zarone, attorneys
of Horty, Springer & Mattern,
discuss strategies to address the growing problem of
physicians resigning privileges to avoid call.
Topics
discussed include:
- How can you assess current competence?
- How can you evaluate the
legitimacy of "resignation" requests?
- Is there an obligation
under EMTALA to ensure that such requests are legitimate?
- How "core" privileges
can help
- Can the physician be required to assume other citizenship
responsibilities in lieu of on-call responsibilities?
- Paying for
call? Should you? Must you? If you do, what are the rules?
- Key
elements for bylaws and policies
- Use of a task force to evaluate
call issues
