Electronic health records are the
wave of the future. The federal government recognizes this, and
recently issued new final regulations that will allow hospitals
to give certain health information technology to physicians without
fear of violating the Stark or antikickback laws. The new final
rules could greatly assist hospitals in their efforts to implement
electronic health records systems, but caution is in order. Donations
must be carefully crafted to fit within the rules and avoid violations
of the federal fraud and abuse laws.
Henry and Phil discuss:
- what type of assistance may hospitals provide
(e.g., hardware, software, connectivity, training)?
- what standards must donated hardware and
software meet?
- can software that relates to patient administration,
scheduling, billing, and clinical support be donated?
- who may receive donated items or services,
and what selection criteria may hospitals use in selecting
recipients?
- what if recipients already have similar equipment?
- what limitations, if any, may the hospital
place on the donated items?
- may hospitals provide assistance to some
providers but not others?
- may hospitals use promises of assistance
in their recruiting efforts, or to induce local physicians
to join their medical staffs?
- what are the documentation requirements?
