No, this isn’t the body count from the last two episodes of "The Sopranos." It’s our initial assessment of what might happen to some common physician-hospital arrangements if the amendments to the Physician Self Referral rules (a/k/a the Stark regulations) that appeared in the July 12, 2007 Federal Register become final.
Tucked away in the revisions to the Medicare physician fee schedule (see pages 38179 through 38187 & pages 38219 through 38224), these proposed rules could spell the end of many common hospital-physician joint ventures. But even more importantly, they could signal a retreat from federal policy which, in a backhanded sort of way, favored physician ownership of diagnostic and outpatient services that resulted in a drain on hospital revenues and quite a few “partnership” offers that CEOs felt they couldn’t refuse.
The regulations, which appear to be a precursor to the long awaited “Phase III” Stark regulations (which is why we are calling them Stark Version 2.5), are the most important development in recent years affecting financial relationships between doctors and hospitals.
