On March 1, 2007, the Panel on
the Nonprofit Sector released a draft set of 31 "Principles
for Effective Practices" by charitable organizations that
could well prove to be a template for a "Sarbanes-Oxley" law
for nonprofits. The Panel was formed a few years ago at the behest
of the U.S. Senate Finance Committee to recommend rules and practices
that could assure that charities and foundations maintain the highest
possible ethical standards. Some of the Panel's previous recommendations
were adopted into law in last year's Pension Protection Act.
In its latest report, the Panel is seeking public
comment on a set of practices that nonprofit organizations should
follow relative to legal compliance, financial management, governance
and fundraising. It is likely that some or all of these may be
considered as the basis for future legislation at the state or
federal level. And even if they are not codified into law, the
principles are a fairly succinct statement of what nonprofit boards
and managers should be doing in terms of running an effective operation.
