If you are unhappy with what Medicaid is paying
you, just wait. If you do not act soon, on January 1, 2007, you
will be paid even less. That is because tucked in the back of the
Deficit Reduction Act of 2005 is the mandate that any entity that
receives more than $5 million per year in Medicaid reimbursement
must adopt written compliance policies. Some have said that this
will require hospitals to instruct its employees on HOW TO FILE
A QUI TAM SUIT AGAINST THE EMPLOYER.
These requirements, along with increased federal funding for fraud
enforcement and the DRA's financial penalty to states that fail
to pass a Medicaid false claims act that includes a qui tam provision,
promise to increase the number of qui tam suits and federal investigations
related to fraud and abuse. Are you ready?
