Proposed Changes in Inpatient Prospective Payment Rules

On Monday, April 14, 2008, CMS issued its proposed changes to the inpatient prospective payment regulations. Within that document were a number of major proposed changes to and new interpretations of the Stark rules. If the changes are enacted, they will significantly affect financial relationships between physicians and hospitals.
Among the changes proposed or discussed in the new rule were the following:
- Disclosure of physician ownership in hospitals to patients
- "Stand in the shoes" provisions that could expand the reach of the Stark Law
- Application of the Stark rules to integrated health care delivery systems
- What constitutes a “physician organization”?
- How long will Stark penalties last?
- Physician-owned implants and medical devices
- Financial relationship reporting and disclosure – version 2.0
- Gainsharing!
