A
physician sued a hospital, seeking to overturn the decision of the hospital's
governing board to terminate his clinical privileges. The decision of the governing
board was based on two separate grounds. First, the physician had failed to
seek reinstatement in a timely manner after he had taken a leave of absence,
and therefore had voluntarily resigned his medical staff membership. Second,
the physician had been under review due to a negative patient outcome and quality
of care issues, and the medical staff executive committee had recommended the
termination of his clinical privileges. Two separate hearings had been held
before judicial review committees and each of the recommendations was upheld.
The California Court of Appeal ruled in favor of the hospital, finding the decision
of the governing board to be supported by substantial evidence in the record.
