The Supreme Court of Idaho reversed a district court’s award of summary judgment in favor of a hospital and held that a hospital could be held vicariously liable under the theory of apparent agency for the negligence of two independent practicing anesthesiologists and an independent practicing cell save technician who were alleged to have caused a hospital patient’s death.
