The United States District Court for the Middle District of Georgia denied a former owner of a cancer treatment center’s motion to dismiss a qui tam action against him alleging that his sale of the cancer treatment center to a healthcare system violated the Anti-Kickback Statute and the Stark Law.

The district court found that the relator adequately asserted a claim under the False Claims Act by stating with particularity the circumstances constituting the basis for the false claim.
