Custer v. Penn State Geisinger Health Sys., No. 03-2185 (3rd Cir. June 30,

The United States Court of Appeals for the Third Circuit held that a release
signed by a physician to settle a prior malpractice suit against a hospital
(arising out of treatment for his meningitis) did not preclude that physician
from subsequently suing the hospital under the Americans with Disabilities
Act when his employment was terminated, the release in the previous case
used the past tense, and the claims of discrimination were not connected in
any way to the prior malpractice suit.
