A hospital employee contracted multi-drug resistant tuberculosis while assisting
an autopsy and subsequently passed the disease on to his family. Following the
death of the employee, his family sued the hospital, claiming that the hospital
knew that autopsies were being conducted under unsafe conditions and that such
an infection was a foreseeable result of those conditions. The Court of Appeals
of Ohio reversed the trial court’s directed verdict for the hospital, saying
that there was evidence from which a reasonable jury could have found in favor
of the family.
