At the end of October, the National Practitioner Data Bank (NPDB) quietly published revisions to its Guidebook that could have far-reaching effects on what hospitals must report. These changes are significant and could result in greater legal risk for hospitals.

The NPDB has taken the position that hospitals must report more than they used to, such as:

• Certain agreements not to exercise privileges;

• Leave of absence while a physician is under investigation;

• Physician resignation while under reappointment review;

• Investigations underway, but not concluded by the time appointment expires;

• Resignation while a performance improvement plan is in effect; and

• Proctoring arrangements, even if the proctor can’t prevent the physician being proctored from doing anything.
